As a user of this website, you are acknowledging that any uses of this website, including any transactions you make, are done in compliance with the terms and conditions listed below.

 

 

The following conditions apply between Crown Ace UK Ltd (We) and the shipper (You) and in using the services of Crown Ace UK Ltd or this web site you accept these conditions.

 

 

 

Delivery and Collection

 

No guarantee of delivery/collection date, departure date or arrival date is given. We will where possible give dates but these are as an indication only. Crown Ace UK Ltd will not liable for delays or diversions howsoever caused.

 

Collection of the loaded cartons MUST be from the ground floor at the front of the building, as near to the road as possible. Collection may be refused or additional charges may be incurred if this condition is not met. We can not specify a morning delivery/collection. Requests for certain time slots can be made but standard collection take place between – 18:00hrs on any given working day.

 

Saturday or Sunday delivery/collection options are possible but are not guaranteed. You must contact Customer Services to find out if these options are available for your consignment and what extra costs will be incurred. Please ensure that you are in during the collection times you request. You will be contacted and charged £10.00 if you are out when the Carrier comes to deliver/collect.

 

Any timed deliveries that fail to be delivered by the specified time (i.e. pre 09:30) will see the chargeable rate reduced to the standard rate for next day deliveries, as long as the delay has not occurred for reasons which are outside the control of the Carrier, as a result of incorrect information from the Sender or there being no one to receive the goods when an attempted delivery is made.

 

Crown Ace UK Ltd or its agents are under no obligation to advise of arrival at destination, any mention of parties to be notified is solely for information of Crown Ace UK Ltd.

 

Surcharges

 

Any reference within these terms and conditions to a carton or item or other similar term shall be taken to be an article or package having a weight not exceeding 35 kilograms and a cubic volume not exceeding 6 cubic feet and with no single dimension exceeding 1.5metres.

 

By entering the weight and dimensions you are paying, based on the information provided, if the goods prove to be heavier or larger than the initial information given, you will be required to pay an additional £1 per Kg for the an additional weight.

 

Surcharges may be levied (where applicable) on services where there is a cost for re-delivery, remote area delivery/collection and for Saturday or Sunday delivery/collection.

 

You are paying for the transit charges only. You are required to pay any, additional, Customs charges that may arise.

 

If your shipment should require additional documentation, you will be contacted by Customer Services. If this can not be provided, you will face delays and could be required to pay an additional premium for transit clearance or the cost for return delivery.

 

Crown Ace UK Ltd reserves the right to stop and/or hold goods for an indefinite period of time where any outstanding monies are owed by the customer. Where the customer refuses payment, it is agreed that Crown Ace UK Ltd are within their rights to sell these goods in order to cover whatever outstanding costs exist with regard to that customer.

 

Should a carton require re-packing by ourselves as a result of you packing a prohibited item a minimum charge of £60 will be payable.

 

If youdespatchmore cartons than have been declared to Crown Ace UK Ltd on the destination details form or without full payment for freight in accordance with the published charges at the time of shipment a minimum charge of £60 will be made for each undeclared item.

 

If youmis-declaredthe dimensions of an item and the cubic volume of the item exceeds 6 cubic feet a minimum charge of £60 will apply.

 

Cartons are non-returnable. We reserve the right to charge £2.50 per carton for any unused cartons. Deposits are non-refundable once cartons have beendespatched.

 

No refunds will be given once loaded cartons have been collected.

 

If you do not write your name and destination on the itemsdespatchedor write a name other than your own without advising us there is a minimum charge of £10 per carton for marking and identification.

 

Crown Ace UK Ltd reserves the right to make a charge or charges to your credit or debit card where payment is required in the following circumstances. 24 hours notice of such a charge will be given by email to the address given on the registration you completed:

 

  • Over weight item(s)despatchedbut not declared.

     

  • Mis-declared dimensions of an item(s).

     

  • Import duty or any other destination charges including rent refused by consignee.

     

  • Charges as a result of cargo not being claimed at destination.

     

  • Item(s) not marked or not marked in accordance with information you have provided.

     

  • Storage charges if shipment ordespatchis not possible following an error or omission by you.

     

Prohibited Items

 

We cannot accept the following and are prohibited for shipment

 

  • Valuable items (Single items having a value exceeding £1,000)

     

  • Perishable goods.

     

  • Foodstuffs of any description

     

  • Liquids

     

  • Tobacco or similar products

     

  • Hazardous materials such as paint, matches, aerosol cans, gas canisters or other flammable materials.

     

  • Firearms and ammunition.

     

  • Plants or soil samples of any kind.

     

  • Live animals (including stuffed)

     

  • Non-prescription drugs or medicines

     

  • Corrosives and explosives.

     

  • Pornography of any description.

     

Inspection

 

Crown Ace UK Ltd, or any of their appointed Agents, has the right to open and inspect your shipment without you being given prior notice.

 

Customs Clearance

 

Unless specified, in writing, any quotes for service are for the transit of goods only. Crown Ace UK Ltd has no control, whatsoever, regarding Customs queries or charges that may arise from the carriage of goods. Any additional Customs charges must be paid by, either, the Sender or the Receiver prior to delivery or when the delivery is made. Crown Ace UK Ltd reserves the right to pass these charges on to the person who has placed the order. If the charges are refused and the delivery is returned, you will also be required to pay for the return delivery.

 

Delay, Damage and/or Loss

 

Goods are not covered for damage during transit as standard, though certain coverage for loss or theft does exist (please review Insurance & Claims below).

 

You are responsible for making sure that your goods are packaged to a professional standard. Crown Ace UK Ltd reserves the right to dismiss any claim where goods were not packaged to such a standard. Please refer to our Packaging section for advice and instructions.

 

In the event of damage, all packaging must be kept for inspection by the Carrier. The goods must be available for inspection in the state in which they were delivered, at the address they were delivered to. If the goods are moved, repaired or if the packaging is not kept, no consideration will be given to your claim.

 

Goods must be signed for as “damaged” when they are delivered, if that is the case. If goods are not able to be inspected upon delivery, they should be signed for as “unchecked”. If goods are signed for without written comment stating “damaged”, “unchecked” or they are signed as “in good condition”, you will not be able to proceed with any claim.

 

All transit times are given as estimations. It is important that you be aware thatunforeseendelays can occur for innumerable reasons and plan for such possibilities. We use a number of trusted Agents to make deliveries and are fully confident that they will get your goods to their destination as fast as is possible but, where other companies make claims of 'guaranteed' delivery times, we do not wish to instill a false sense of security to any of our Clients. While it is most likely that the goods shipped will arrive in good time, we would advise you to communicate with those receiving the goods and inform them of the possibility of delays.

 

Crown Ace UK Ltd will make ever reasonable effort to deliver the shipment according to their regular delivery schedules but these are NOT GUARANTEED AND DO NOT FORM PART OF THE CONTRACT. Crown Ace UK Ltd is not liable for any damages or loss caused by delays.

 

Insurance and Claims

 

In the event of loss of a carton you would receive the actual value of the goods lost as ascertained by reference to its repair, replacement, resale or fair market value at the time and place of collection or value declared on your packing list, whichever is the less to a maximum of £25 per carton.

 

We will not be responsible for damage to contents of a carton or loss from a carton. The only exception to this clause is in the event of there being clear external damage to the carton, this damage must be noted on the receipt signed when your cartons are received, we will not accept any claim for damage to contents where no note of external damage has been made. If your claim is accepted you would receive the actual value of the goods lost as ascertained by reference to its repair, replacement, resale or fair market value at the time and place of collection or value declared on your packing list, whichever is the less to a maximum of £25 per carton.

 

Notification by email of your claim must be received within 5 days of goods received in Malaysia. Notifications not received within this time period will be time barred and will not be accepted.

 

If you have paid the charge for extended transit cover Crown Ace UKLtd'sliability for the loss of any consignment on any service shall;

 

  • Be limited to a maximum of £1,000 per consignment.

     

  • Be limited to the actual value of the goods lost as ascertained by reference to its repair, replacement, resale or fair market value at the time and place of collection or value declared on your packing list, whichever is the less. In no event shall such value exceed the original price that you actually paid for the item plus 10%.

     

  • You shall fully disclose the nature of the goods to be covered. We shall, at our sole discretion, decide whether extended transit cover shall apply to any consignment for which it is required.

     

  • Cover is for loss of a whole carton or cartons, you are not covered for breakage, scratching, denting, chipping, staining and tearing, including trunks suitcases and the likes. The only exception to this clause is in the event of there being clear external damage to the cartons, this damage must be noted on the receipt signed when your boxes are received, we will not accept any claim for damage to contents where no note of external damage has been made.

     

  • Notification by email of your claim must be received within 5 days of receipt. Notifications not received within this time period will be time barred and will not be accepted.

     

  • It is also advised that you provide photographic evidence of damage in addition to the physical inspection by the Carrier.

     

  • No consideration will be given to any claim where the goods are deemed to have been insufficiently packaged upon inspection by the Carrier.

     

  • If the goods are not correctlylabelled, the claim will be voided.

     

You must inspect the cartons on delivery and any damage should be recorded on the delivery note. If you sign for the cartons in good order and condition we are unable to claim against the carrier and you will be responsible for any replacement costs. Any claim for compensation must be made to Crown Ace UK Ltd in writing within 5 days of receipt, if you fail to do so we will not be responsible.

 

Liability

 

  • The person placing the order is responsible for all information entered Crown Ace UK Ltd will not be held responsible for any incorrect information that is given and no claims or refunds will be considered in that instance.

     

  • In using our service, you are paying for transit charges only and Crown Ace UK Ltd accept no liability for any Customs Duties or Taxes that may arise. In using our services, you are accepting full liability for any and all Customs Duties, Taxes and/or additional surcharges that may arise regarding the shipment of your goods.

     

  • Liability is limited to the company who are carrying the goods. Crown Ace UK Ltd reserves the right to deny liability where the goods have been sent via a Third Party where no additional insurance has been requested – in using our service you are accepting that no claim may be brought in such an instance.

     

  • Loss or damage under the following conditions will not be covered:
     

     

    • Acts of God (or similar Deity)

       

    • Consequence of War

       

    • Insufficient packaging / Incorrectlabelling

       

    • Prohibited contents

       

  • Crown Ace UK Ltd will deal only with the person who placed the order.

     

  • Liability is limited to the cost of transit only when the goods have been fully insured (and, in such instances, also to the insured value if a claim is raised and proved). Other than where full (additional) insurance is taken out, liability will be limited to the ‘standard liability’ of the particular service used and, thereby, will not, automatically, include reimbursement of the transit costs. We will not be liable for any further claims. Nor will we, in any circumstances, accept liability for; any loss of forecasted profit(s), administrative inconvenience, disappointment, indirect or consequential loss and/or damage arising from any problem in relation to the service you have ordered.

     

Any claim must be submitted, in writing, to us within 5 days of receipt in the case of loss and 10 days in the case of damage when the goods have been insured.

 

Crown Ace UK Ltd reserves the right to change the terms and conditions at any time by posting changes on-line. In the event of the conditions changing after you have made a deposit payment, the terms and conditions applicable at the time of the payment would take precedence.

 

Severability

 

If any part of these terms and conditions is found to be unenforceable as a matter of law, the enforceability of any other part of these terms and conditions will not be affected.

 

Governing Law

 

These terms and conditions and any contract between us shall be governed and interpreted in accordance with English Law and the English Courts shall have jurisdiction over any disputes between us.

 

Statutory Rights

 

These terms and Conditions are in addition to your statutory rights, as a consumer, which remain unaffected.

 

Complaints

 

Our aim is to provide outstanding Customer service. If you have any complaint regarding the service you have received, please contact our Customer Service.

 

All information provided by Crown Ace UK Ltd is given without prejudice or guarantee.

 

Prices may alter without notice.

 

Special Offers may be withdrawn without notice.

 

The following conditions are printed on Crown Ace UKwaybills. Whether a Crown Ace UKwaybill is issued or not use of Crown Ace UK Ltd is wholly conditional on your full acceptance of these conditions:

 

Received by Crown Ace UK Ltd in apparent good order and condition (unless otherwise noted herein) the total number or quantity of Cartons or other packages or units indicated in the carton entitled "Number and kind of packages" for carriage from the Place of Receipt or the Port of Loading, whichever is applicable, to the Port of Discharge or Place of Delivery, whichever is applicable.

 

This Waybill is not a document of title to the Goods. Delivery will be made to the Consignee named, or hisauthorisedagent, on production of proof of identity at the Portof Dischargeor the Place of Delivery, whichever should be applicable. Should the Consignee require delivery to a party and/or premises other than as shown in the "Consignee" carton, and then written instructions must be given by the Consignee to Crown Ace UK Ltd, the Carrier or his agent.

 

The Shipper accepts the standard terms of Crown Ace UK Ltd which prohibits the shipment of hazardous, perishable, prohibited, valuable or fragile goods and that shipment is entirely at their own risk. The Shipper accepts liability for all charges, duties and penalties as may be required whether the Goods are delivered or not. Unless confirmed in writing by Crown Ace UK Ltd the Goods are not insured against loss or damage howsoever caused.

 

Freight shall be deemed fully earned on receipt of the goods by Crown Ace UK Ltd and shall be paid and non-returnable in any event.

 

If any of these conditions or any part is held to be invalid for any purpose, it shall for that purpose be deemed to have been omitted, but shall not prejudice the effectiveness of the rest of these conditions.
